Welcome to mysitebroker for Real Estate. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Services Overview

mysitebroker for Real Estate provides custom website design and development services for real estate professionals. Our service packages include:

• Signature Package ($4,997): Custom homepage design, 5 interior pages, mobile responsive design, contact forms, and 30-day support.
• Prestige Package ($9,997): Everything in Signature plus IDX integration, property search, CRM setup, advanced SEO, and 90-day support.
• Legacy Package (Custom Pricing): Fully custom solutions including multi-agent platforms, custom applications, and dedicated support.

2. Payment Terms

By purchasing our services, you agree to the following payment terms:

• A 50% deposit is required to begin work on your project.
• The remaining 50% is due upon project completion, before the website goes live.
• All prices are in US Dollars unless otherwise specified.
• Payments are non-refundable once work has commenced, except as outlined in our Refund Policy.

3. Project Timeline

Estimated delivery times are provided as guidelines and may vary based on:

• Project complexity and customization requirements
• Client responsiveness in providing content and feedback
• Revision requests beyond the included revision rounds

We will communicate any significant delays and work with you to establish revised timelines.

4. Client Responsibilities

To ensure successful project completion, clients agree to:

• Provide all necessary content (text, images, logos) in a timely manner
• Respond to communications and feedback requests within 5 business days
• Provide accurate business information for website content
• Review and approve deliverables at each project milestone
• Ensure all provided content does not infringe on third-party rights

5. Intellectual Property

Client Content: You retain all rights to content you provide (logos, photos, text). You grant us a license to use this content for the purpose of creating your website.

Our Work: Upon full payment, you receive ownership of the custom design and code created specifically for your project. We retain the right to showcase your website in our portfolio unless otherwise agreed.

Third-Party Assets: Some elements (fonts, stock images, plugins) may be subject to third-party licenses. We will inform you of any such requirements.

6. Revisions and Changes

Each package includes a specified number of revision rounds:

• Signature: 2 rounds of revisions
• Prestige: 3 rounds of revisions
• Legacy: Unlimited revisions during the project phase

Additional revisions beyond the included rounds may incur extra charges at our standard hourly rate.

7. Hosting and Maintenance

Website hosting and ongoing maintenance are not included in the initial project cost unless specifically stated. We offer optional ongoing support packages:

• Monthly maintenance and updates
• Hosting management
• Content updates and modifications
• Technical support

8. Warranties and Disclaimers

We warrant that our services will be performed in a professional manner consistent with industry standards. However:

• We do not guarantee specific results, rankings, or lead generation outcomes.
• Website performance depends on factors beyond our control (hosting, third-party services).
• We are not liable for issues arising from client modifications to the delivered website.

9. Limitation of Liability

To the maximum extent permitted by law, mysitebroker for Real Estate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability shall not exceed the amount paid by you for the services in question.

10. Termination

Either party may terminate the agreement with written notice. Upon termination:

• Client is responsible for payment for all work completed to date.
• We will provide all completed deliverables upon receipt of payment.
• Deposits are non-refundable if work has commenced.

11. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the project. This includes business strategies, pricing information, and technical implementations.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Tampa, Florida, in accordance with the rules of the American Arbitration Association.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the new Terms.
